What is the territorial validity of regulation (ES) 261/2004?

Regulation (ES) 261/2004 applies to flights that originate from EU with a given airline that is also registered within the EU, flights that originate from EU with an airline, which isn’t registered in the EU, and also flights that originate outside EU but involve an airline registered in the EU.

In what cases am I entitled to receive compensation?

You are entitled to receive a compensation in the following cases:

  • Flight delay for more than 2 hours
  • Flight cancellation, which was not announced by the airline 14 days prior to departure.
  • Flight redirected, which occurs when you reach your destination by being on a flight with a different flight number of a same airline or possibly via a different airline resulting with a delay to the original arrival time and/or date.
  • Boarding refused due to the fact that there are more passengers than the number of seats on board (the airline sold more tickets to that of the available seating or the airline changed the plane type resulting with a smaller holding capacity)
  • Downgrading your seating class due to not having the given seating class available.
  • Lost, damaged, or delayed baggage due to an airlines fault.

  • 400 EURO delay of 3 hours; applicable with flights above 1,500km within the EU and with flights from 1,500km to 3,500km outside the EU

What is your rightful compensation for the redirection of a given flight?

Your flight is redirected if you reached your given destination with a different flight number to that of the original one or with a different airline, which in return resulted from reaching your destination with a delay.

What is your rightful compensation for a degrading of your flight class?

  • 30% of the ticket fee, applicable with any flights under 1,500km
  • 50% of the ticket fee, applicable with flights above 1,500km within the EU and with flights from 1,500km to 3,500km outside the EU
  • 75% of the ticket fee, applicable with flights that are above 3,500km

What is your rightful compensation in the case of lost, damaged, or delayed baggage?

In case of lost, damaged, or delayed baggage due to the fault of the airline, you may be entitled for a compensation up to around 1,220 EURO. The complaint must be handed in with 7 days (incase of delayed baggage up to 21 days) from the day of initially obtaining your baggage.

Which flights entitle you to a rightful compensation?

Your right for a compensation is available for every flight (including charter flights) that departs from EU or arrives in EU when departing outside of the EU if the airline is registered within the EU.

How do you calculate the flight distance?

The distance is calculated from the airport where the given issue took place, which doesn’t necessarily have to be the airport from which you have initially departed.

Obtaining your compensation is free of charge. Our revenue is to be deducted from the final compensation amount.

Do you have the right to receive a compensation even when your flight was covered by a travel agency package?

Yes, it does not matter whether you were traveling individually or via a traveling agency.

How long after an incident are you allowed to request for a compensation?

Your request for a compensation may be placed within 24 calendar months from the date of your flight with the given incident .

How long does the whole process take in obtaining your rightful compensation?

Cases usually are completed within a 45-day period, however this depends on the complexity of the situation. Some case may take longer, which you will be kept informed about throughout the process.

In what cases are you not entitled to receive a compensation?

If your flight has been cancelled due to extreme situations that could have not been prevented such as unexpected harsh weather, if your airline has informed you about the cancelation of the flight 14 days prior to departure, or if you have been offered an alternative flight with the same flight date and time as that of the original flight, you are not entitled for a compensation.
